These Terms of Service (“Terms”) govern your access to and use of webworksoc.com (the “Site”), operated by Web Works OC (“Web Works OC,” “we,” “us,” or “our”). Please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. About This Site
This Site introduces Web Works OC and the web design services we offer. Its content, including our pages, any pricing examples, portfolio descriptions, and other materials, is provided for general informational purposes only. It is not a quote, proposal, offer, or contract, and nothing on the Site (including submitting our contact form or exchanging emails with us) creates a client relationship or a binding agreement on its own.
If we decide to work together, the specific terms of your project, including scope, deliverables, timeline, fees, ownership, and responsibilities, will be set out in a separate written agreement signed by both parties. That agreement, not this Site, governs any work we perform for you. If there is any conflict between this Site and a signed client agreement, the signed agreement controls.
2. Eligibility
The Site is intended for business owners and their representatives, and for individuals who are at least 18 years old. By using the Site, you represent that you meet these requirements and that any information you provide is accurate and your own to share.
3. Acceptable Use
You agree to use the Site only for lawful purposes and legitimate business inquiries. You agree not to:
- attempt to disrupt, damage, or gain unauthorized access to the Site, its servers, or connected systems;
- submit false, misleading, unlawful, infringing, or malicious content through our form;
- use the Site to transmit spam, malware, or automated queries; or
- copy, scrape, or harvest content or data from the Site without our permission.
We reserve the right to restrict or refuse access to anyone who misuses the Site.
4. Intellectual Property
All content on this Site, including its design, layout, text, graphics, logos, and code, is the property of Web Works OC or its licensors and is protected by copyright, trademark, and other intellectual-property laws. The “Web Works OC” name and logo are our marks. You may view and share the Site for personal, non-commercial reference, but you may not copy, reproduce, modify, distribute, or reuse any part of it without our prior written permission. Any examples shown describe the kinds of work we do.
5. Third-Party Services and Links
The Site relies on trusted third-party providers, such as Cloudflare and Resend, to operate and to process contact-form submissions. These services are governed by their own terms and privacy policies, which we do not control. The Site may also contain links to third-party websites, provided for your convenience; we are not responsible for their content or practices.
6. Disclaimer of Warranties
We work to keep the Site accurate, current, and available, but we provide it on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that the general information on it applies to your particular circumstances. Anything you read here is a starting point for a conversation, not professional advice tailored to you.
7. Security
We take the security of the websites and systems we build seriously and follow current best practices in our work. No website, server, or online system can be guaranteed completely secure at all times, and we do not warrant that any site will be free from vulnerabilities, intrusion, or disruption.
During an active engagement, we monitor the sites we maintain and apply updates as appropriate to keep them secure and current. The scope of that ongoing monitoring and maintenance is defined in the client’s separate written agreement. Outside of an active engagement, we are not responsible for a site’s ongoing security or maintenance.
8. Limitation of Liability
To the fullest extent permitted by law, Web Works OC, its owner, and anyone acting on its behalf will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site or your inability to use it, even if we have been advised of the possibility of such damages. To the extent any liability cannot be excluded, it is limited to the greatest extent permitted by law.
This section concerns the Site itself. The terms of any project we take on are governed by the separate written agreement described in Section 1.
9. Indemnification
You agree to indemnify and hold harmless Web Works OC and its owner from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Site or your violation of these Terms.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we handle the information you share. Please review it to understand our practices.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before pursuing any formal dispute, please contact us first so we can try to resolve the matter directly. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California, and you consent to venue there.
12. General Terms
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and any signed client agreement, make up the entire agreement between you and us regarding the Site. You may not transfer your rights under these Terms without our consent.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after any change constitutes acceptance of the updated Terms.
